Terms of Service

Please read these terms before using MaxSend. By using the app, you agree to them.

1. The service

MaxSend is a native macOS and iPadOS application that helps you compose email campaigns, import recipient lists, and transmit messages through SMTP servers you configure. MaxSend is a sending tool only; it does not provide email hosting, list acquisition, or deliverability guarantees.

2. Your responsibilities

You are solely responsible for the content you send, the recipients you contact, and compliance with applicable laws (including CAN-SPAM, GDPR, CASL, and similar regulations). You must have permission to email each recipient, honor opt-out requests, and include accurate sender information. You may not use MaxSend for unsolicited bulk mail, phishing, malware distribution, or any unlawful purpose.

3. SMTP and third-party services

You provide your own SMTP credentials and server. MaxSend connects to that server on your behalf; your provider's terms and policies also apply. You are responsible for securing your accounts, rotating compromised passwords, and configuring SPF, DKIM, and DMARC for your sending domain.

4. No guarantee of delivery

Inbox placement depends on domain reputation, authentication, list quality, and recipient mailbox policies. MaxSend does not guarantee that messages will be delivered, accepted, or placed in the inbox. Rejections, bounces, and spam-folder routing reported by remote servers are normal operational outcomes.

5. Acceptable use

MaxSend is not designed to circumvent spam filters or abuse detection. Do not attempt to disguise sending identity, forge headers, or exceed reasonable sending limits imposed by your provider. We may update the app to reinforce responsible sending practices.

6. Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS LIABILITY FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF MAXSEND, INCLUDING LOST REVENUE, REPUTATION HARM, OR PROVIDER ACCOUNT SUSPENSION.

These terms may be updated from time to time; continued use after changes constitutes acceptance. For questions, contact the developer through the App Store listing or our support page.
